A lawsuit claims Skittles are unsafe to eat.

Mars, a candy-maker based in California, has been sued for making Skittles with titanium dioxide, a known toxin.

A lawsuit claims Mars is still using the chemical compound in products, including Skittles, despite announcing in 2016 that it would eliminate it from its products.

A Mars spokesperson in a statement said, "While we do not comment on pending litigation, our use of titanium dioxide complies with FDA regulations." 

According to the FDA, "The color additive titanium dioxide may be safely used for coloring foods," as long a few restrictions are met, including that the quantity doesn't exceed 1 percent of the food's weight. 

According to the lawsuit, titanium dioxide was banned in France beginning in 2019. A few months later, in May 2021, the European Food Safety Authority declared it unsafe to consume.
